Pet owners asked to bring dogs, cats inside from freezing weather ...

As temperatures dip below zero, pet owners are being asked to bring their dogs and cats indoors.

Several residents in one south side neighborhood complained to Fox59 about seeing two boxers left outdoors for weeks in the 5300 block of Yucatan Drive.

While they didn?t want to reveal their identities, they told Fox59, the owners moved away some time ago and come back periodically to feed the dogs. Even with a dog house and each other to keep warm, neighbors are worried the dogs won?t make it through the sub zero temperatures.

?They?re cold when they go outside, just like with you,? explained veterinarian Dr. Greg Borlik with Cottage Animal Clinic in Carmel.

He said dogs and cats are extremely vulnerable in this weather, especially animals with short hair, like the boxers.

?If they?re out in the elements, they can get forstbit and they also can freeze to death,? said Borlik.

Fox 59 contacted Marion County Animal Care and Control to alert them about the boxers. Concerned neighbors said they would call ACC as well.

First on CNN: Attracting minority voters a key GOP goal as Obama begins second term

Washington (CNN) ? Days after President Barack Obama is sworn-in for a second term, Republican leaders from across the country will assemble in the southern city where Obama accepted his party?s presidential nomination in September to strategize a path forward for the GOP in a nation experiencing major demographic shifts.

It will be a three-day discussion focused primarily on how to grow the Republican Party by convincing black, Hispanic and Asian voters that the GOP better represents their values than the Democratic Party, according to a party official involved in the planning of the Republican National Committee?s winter meeting in Charlotte, North Carolina, who spoke on the condition of anonymity.

The argument, certainly in the near term, will be tough sell for the GOP, given the unyielding positions and controversial comments from some conservative lawmakers and opinion leaders on the issue of illegal immigration and Democrats? deep ties to the black community. The CNN Exit Poll from the 2012 presidential election showed that Obama won 93% of the black vote, 71% of the Hispanic vote and 73% of the Asian vote.

?The big takeaway that will be discussed during the week and championed by Priebus is that the party needs more voters and needs to do a better job of reaching out to minority communities and not just six months before the election,? said the Republican official.

Priebus is RNC Chairman Reince Priebus, a 40-year-old lawyer from Wisconsin, who, until two years ago, was relatively unknown outside of the small, clubby world of the committee, an organization that has only 168 members. In January 2011, Priebus emerged from a pack of similarly ambitious Republicans, including his former political ally and then-Chairman Michael Steele, for the right to lead the national party. He inherited more than $20 million of debt after the 2010 midterm elections and a depressed RNC donor base that was being courted by White House hopefuls and congressional Republicans.

Priebus eventually pulled the RNC out of the red and handed Mitt Romney a relatively healthy national party operation when the former Massachusetts governor became the Republican presidential nominee. Paperwork filed with the Federal Election Commission shows that the RNC ended 2012 with about $3.3 million in the bank and no debt.

With the White House in Democratic hands and Capitol Hill Republicans focused on legislative fights with Obama, the task to grow the GOP, for now, rests primarily on his shoulders. He is expected to win a second term as national chairman as he faces only token opposition from a Maine Republican at the party?s meeting in North Carolina. Republicans won the state in November, the only bright spot in crushing November defeats where Obama easily defeated Romney, Republicans lost ground in the House and failed to regain control of the Senate.

The theme of the RNC meeting is ?Renew, Grow, Win,? a tacit admission that the party has some serious political reckoning to deal with in the coming months, especially with the fast-growing Hispanic population.

?The ideas and the principles of the party are sound,? said the GOP source. ?But the way they need to be communicated needs to be updated to become more relatable and relevant.?

The source added that in his speech next week to fellow Republicans, Priebus will offer a ?very optimistic and bold agenda,? but was careful not to say much more beyond the overall theme of trying to broaden the party?s appeal.

After the election, Priebus pledged to do a top-to-bottom review of the party, named it the ?Growth and Opportunity Effort? and appointed five Republicans to lead the project.

While minority outreach and recruitment will serve as a main theme of the Charlotte meeting, Priebus is also expected to emphasize a need to update the party?s digital operations. The Obama campaign?s emphasis on developing and utilizing cutting edge technology and fusing it with traditional get-out-the vote methods was widely praised and considered key to the president winning a second term.

Representatives from companies such as Facebook, Google and Twitter are expected to attend the meeting, said the source, as will Louisiana Gov. Bobby Jindal, one of many Republicans said to be eyeing a run for president in 2016. Jindal will speak at a dinner on Thursday.

?Simply put, we cannot win if we continue to fight just over battleground states,? said the source, referring to the narrow mathematical paths to victory Romney had in the election. Large states such as California, New York and Pennsylvania are considered Democratic strongholds, and besides North Carolina, Romney failed to win any of the so-called swing states that neither party has a lock on, such as Colorado and Nevada, two states with growing Hispanic populations.

Fed chairman urges Congress to raise debt limit

WASHINGTON Federal Reserve Chairman Ben Bernanke said Monday that it's important that Congress raise America's borrowing limit before the Treasury runs out of maneuvering room to avoid a potential default on U.S. debt.

Bernanke, speaking at the University of Michigan, said the approaching debt limit is one of the "critical fiscal watersheds" for the government in coming weeks.

President Barack Obama also spoke Monday about the urgency of raising the limit. Obama said he wouldn't let congressional Republicans use the debt limit as leverage in negotiations over spending cuts.

Bernanke noted that an impasse over the debt ceiling in 2011 led to a rating downgrade of long-term U.S. debt, the first time that's occurred. He said Congress should raise the ceiling to "avoid a situation where our government doesn't pay its bills."

The Fed decided last month to keep buying $85 billion a month in Treasurys and mortgage bonds to try to keep borrowing costs low and encourage more spending. The bond-buying program was left open-ended.

But it turned out that Fed officials differed about how long the bond purchases should continue. When the minutes of the meeting were released Jan. 3, they revealed that "several" committee members thought the purchases should slow or end well before year's end. These officials fear the bond buying is keeping rates so low for so long that it could ignite inflation or encourage speculative buying of risky assets.

Still, many economists have said they think the Fed will maintain its bond purchases at their current level through 2013.

On Monday, Bernanke didn't address the divisions within the Fed. But he said he thought the new round of bond buying was providing key support. He said the Fed will continue to assess the benefits of the bond buying against any risks of continuing the purchases.

Bernanke said the purchases have shown that the Fed still has "ammunition" to aid the economy even after having cut short-term interest rates to near zero.

Last month, the Fed also said it planned to keep its key short-term interest rate at a record low even after unemployment falls close to a normal level - which it said might take three more years. Unemployment remains high at 7.8 percent because the economy is growing too slowly and not creating jobs fast enough.

In December, employers added 155,000 jobs, roughly matching the monthly average in 2011 and 2012. That's just been enough to slowly reduce the unemployment rate, which fell 0.7 percentage point during 2012.

The Fair Labor Standards Act (FLSA) is expansive enough to classify individual managers and corporate officers as employers. Upshot: You can be individually liable for FLSA violations. Key: the amount and degree of operational control those individuals have over employees. Two cases illustrate.

Case #1?Personal liability sticks. An employee was fired after a heated argument with his supervisor. He sued his employer for violating a slew of federal and state employment laws, including sexual har?assment and retaliation under Title VII and Florida?s civil rights laws.

The employer and the employee?s manager were also sued under the FLSA.

The employer argued that the manager wasn?t an employer under the FLSA because she was only a run-of-the-mill supervisor. A federal trial court ruled otherwise. Court: Whether a manager is an employer depends on the entire picture, not technical or isolated factors. This manager was an employer, the court concluded, since she supervised the employer?s day-to-day operations, prepared weekly time sheets, issued disciplinary warnings, controlled employees? work hours and directly supervised employees. (Arean v. Central Florida Investments, Inc., No. 8:10-cv-2244-T-33MAP, D.C. M. Fla., 2012)

Case #2?Personal liability fails. A bartender sued his employer and one of the company?s owners individually for FLSA violations. Employee?s contentions: As a corporate officer, the owner had inherent power to control employees? conditions of employment. Owner?s defense: He wasn?t involved in the day-to-day running of the business and didn?t supervise employees.

An appellate court ruled in the owner?s favor. Court: Authority that would lead to personal liability for FLSA violations can?t be inferred from an individual?s status as a corporate officer. Instead, the individual must have operational control over employees?the power to hire and fire, the ability to supervise, the power to set wages, etc. While each element need not be present in every case, finding employer status when none of those factors was present wasn?t appropriate, the court concluded. (Gray v. Powers, No. 10-20808, 5th Cir., 2012)

THE TAKEAWAY: Both courts articulated a ?common test used to determine whether individuals are personally liable under the FLSA. As with all issues related to the FLSA, the linchpin is control?who has it and how it?s used. To avoid personal liability, you must show that, given the extent of your authority, you didn?t contribute to the FLSA violations and tried to resolve employees? issues, but couldn?t.
